These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and MustServer Cloud, Inc. ("MustServer", "we", "us") governing your access to and use of our Cloud VPS, Web Hosting, and Mail Gateway services (the "Services").

1. Acceptance of terms

By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Services.

2. Accounts and registration

You must provide accurate, current information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Description of services

MustServer provides Cloud VPS (virtual machines), managed Web Hosting, and a Mail Gateway relay service, as described on our product pages at the time of order. Specifications, regions, and included features may evolve; material reductions to a plan you're subscribed to will be communicated in advance.

4. Billing, payment, and renewals

Fees are billed in advance on a monthly, yearly, or hourly basis as selected at checkout, and processed through Stripe. Subscriptions renew automatically at the then-current price unless cancelled before the renewal date. Failure to pay may result in suspension or termination of the Services as described in Section 8. All fees are exclusive of applicable taxes unless stated otherwise.

5. Service availability and SLA

We target the uptime levels published on our product pages (e.g. 99.99% for Cloud VPS network and power availability) and, where a Service Level Agreement applies, remedy shortfalls solely through the service credits described in that SLA. Service credits are the customer's sole and exclusive remedy for any failure to meet an availability target.

6. Acceptable use

Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination under Section 8.

7. Your content and backups

You retain ownership of the content, code, and data you host on the Services ("Customer Content"). You are solely responsible for the legality of Customer Content and for maintaining your own independent backups. While we offer automated backup features on eligible plans as a convenience, we do not guarantee the completeness or recoverability of any backup and are not liable for data loss — see Section 10.

8. Suspension and termination

We may suspend or terminate the Services, with or without notice, if: (a) payment is overdue; (b) we reasonably believe the Acceptable Use Policy has been violated; (c) required by law or a competent authority; or (d) continued provision would create a security or legal risk to MustServer or third parties. You may cancel at any time from the member panel; cancellation does not entitle you to a refund except where required by law.

9. Disclaimer of warranties

Except as expressly stated in an applicable SLA, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. MustServer does not warrant that the Services will be uninterrupted, error-free, or completely secure.

10. Limitation of liability

To the maximum extent permitted by applicable law, MustServer and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Services, even if advised of the possibility of such damages. MustServer's total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to MustServer for the specific Service giving rise to the claim in the three (3) months preceding the event. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).

11. Indemnification

You agree to indemnify and hold MustServer harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services in violation of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.

12. Force majeure

Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, power or internet backbone failures, government action, labor disputes, or telecommunications failures.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be notified via the email on your account or a notice on our website at least 14 days before taking effect. Continued use of the Services after that date constitutes acceptance of the revised Terms.
